1. SPONSOR
The Pool House Weekly Giveaway Program (the “Giveaway Program”) is sponsored by Pool House New York, Co. (“Pool House,” “we,” “our,” or “us”).
2. ELIGIBILITY
The Giveaway Program is open to legal residents of the United States who are eighteen (18) years of age or older at the time of entry.
Employees, contractors, officers, directors, and immediate family members of Pool House, as well as individuals residing in the same household, are not eligible to participate.
Void where prohibited by law.
3. GIVEAWAY ANNOUNCEMENTS
Pool House periodically conducts giveaways, contests, sweepstakes, and promotional campaigns in connection with product launches, restocks, marketing initiatives, and other business activities.
The specific details of each giveaway, including but not limited to:
- Prize(s)
- Number of winner(s)
- Entry requirements
- Giveaway period
- Winner selection method
- Announcement date
will be disclosed in the applicable giveaway announcement, including but not limited to Instagram posts, Instagram stories, email campaigns, SMS campaigns, website pages, or other promotional materials.
The applicable giveaway announcement is incorporated into these Official Giveaway Rules.
4. HOW TO ENTER
To enter a giveaway, participants must complete the entry requirements specified in the applicable giveaway announcement.
Entry requirements may include actions such as:
- Following Pool House social media accounts
- Liking or sharing social media content
- Subscribing to email communications
- Subscribing to SMS communications
- Completing an online entry form
- Submitting comments, responses, photographs, videos, or other content
- Any other lawful entry method described in the giveaway announcement
Unless otherwise stated, completion of all required actions constitutes one (1) entry.
Pool House reserves the right to verify eligibility and entry compliance before awarding any prize.
5. WINNER SELECTION
Winner selection methods may vary depending on the giveaway.
As disclosed in the applicable giveaway announcement, winners may be selected by:
(a) Random drawing from eligible entries;
(b) Judged criteria, including creativity, originality, quality, engagement, or other subjective criteria determined by Pool House; or
(c) A combination of random selection and judged criteria.
Pool House’s decisions regarding winner selection are final and binding.
6. WINNER NOTIFICATION
Potential winners may be contacted through Instagram, email, SMS, telephone, or any contact information provided during entry.
If a potential winner:
- Cannot be contacted,
- Does not respond within seven (7) days,
- Is determined to be ineligible,
- Fails to comply with these rules, or
- Declines the prize,
Pool House may select an alternate winner.
7. PRIZES
Prize descriptions will be disclosed in the applicable giveaway announcement.
Unless otherwise stated:
- Prizes are non-transferable.
- No cash substitution will be provided.
- Pool House may substitute a prize of equal or greater value if necessary.
Pool House is solely responsible for awarding prizes offered through the Giveaway Program.
8. USER CONTENT
If a giveaway requires submission of comments, photos, videos, testimonials, or other content, entrants grant Pool House a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, display, distribute, and promote such content in connection with Pool House’s business and marketing activities.
Entrants represent that submitted content does not violate the rights of any third party.
9. PUBLICITY RELEASE
To the fullest extent permitted by law, acceptance of a prize constitutes permission for Pool House to use the winner’s name, first initial of last name, city, state, social media handle, likeness, statements, and submitted content for advertising and promotional purposes without additional compensation.
10. DISQUALIFICATION
Pool House reserves the right to disqualify any entrant who:
- Violates these Official Giveaway Rules;
- Uses automated systems, bots, scripts, or fraudulent methods;
- Submits false information;
- Attempts to manipulate the giveaway process; or
- Acts in a manner inconsistent with the spirit of the promotion.
11. LIMITATION OF LIABILITY
By participating, entrants agree to release and hold harmless Pool House New York, its affiliates, officers, employees, contractors, agents, and representatives from any claims, damages, losses, liabilities, or expenses arising out of participation in the Giveaway Program or acceptance, possession, use, or misuse of any prize.
12. PRIVACY
Information collected in connection with the Giveaway Program is subject to Pool House’s Privacy Policy and California Financial Incentive Notice.
Participants may unsubscribe from marketing communications at any time. Unsubscribing will not affect eligibility for a giveaway that has already concluded.
13. MODIFICATION OR TERMINATION
Pool House reserves the right to modify, suspend, cancel, or terminate any giveaway if fraud, technical failures, legal requirements, platform changes, or circumstances beyond Pool House’s reasonable control compromise the integrity or proper operation of the giveaway.
14. PLATFORM DISCLAIMER
Giveaways may be promoted on Instagram, Facebook, TikTok, Shopify, Klaviyo, or other platforms.
These giveaways are not sponsored, endorsed, administered by, or associated with Instagram, Meta, Facebook, TikTok, Shopify, Klaviyo, or any other third-party platform unless expressly stated otherwise.
15. GOVERNING LAW
These Official Giveaway Rules shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
16. AGREEMENT TO RULES
By participating in any Pool House giveaway, contest, sweepstakes, or promotional campaign, participants agree to be bound by these Official Giveaway Rules and all decisions made by Pool House, which shall be final and binding in all matters relating to the Giveaway Program.
